Q1: What are the hours of the Commission?

A1: Generallw,we are open from 9 a.m. to 5 p.m. (Excludes weekends and holidays)

Q2: Do I need to pay a fee to seek help from the Commission, as with a court?

A2: No. There are absolutely no fees involved with using our services.

Q3: When I seek help from the Commission,will my confidentiality be protected?

A3: Commission members and office staff will never disclose confidential information obtained related to inquiries/cases.
    However, the fact that a request for conciliation or a complaint regarding unfair labor practices was received will be published in the Commission’s annual report.
    Also, please note that when an order concerning unfair labor practices is issued, a summary of the order will be posted on the website of the Tokyo Metropolitan Government and that of the Commission, along with the complete text of the order published in the record of orders concerning unfair labor practices.

Q4: Do I need to hire a lawyer to seek help from the Commission?

A4: No, it is not necessary.
    Most conciliation cases are actually handled without a lawyer. With respect to filing a complaint of unfair labor practices, there are many cases in which a lawyer is retained and the examination is conducted.

Q5: Can I make a request for conciliation by postal mail? 

A5: A staff member handling your case will need to ask you about the course of events that led up to your filing a request and other matters, so please bring the documents to the Tokyo Metropolitan Government Labor Relations Commission in person.

Q6: Can I make a request for conciliation as an individual? 

A6: No, individual workers cannot make a request for conciliation. Conciliation proceedings will be held when a request is filed by a labor union or labor organization, an employer, or by both parties.

Q7: Can I make a request for conciliation to the Commission when the labor union is located in Tokyo but the employer is headquartered in another prefecture? 

A7: Conciliation cases, when related to a labor dispute confined to one prefecture, should be handled by the LRC of that prefecture.

Q8: Can I name a specific conciliator to handle my case? 

A8: No. The Chairperson of the Commission will appoint a conciliator from previously selected candidates.

Filing a Complaint to Remedy Unfair Labor Practices

Q9: Can I file a complaint to remedy unfair labor practices by postal mail?

A9: A staff member handling your case will need to ask you about the course of events that led up to your filing a complaint and other matters, so please bring the documents to the Tokyo Metropolitan Government Labor Relations Commission in person.

Q10: Can I file a complaint as an individual?

A10: A complaint to remedy unfair labor practices can be filed by the labor union that claims to have been a victim of an unfair labor practice, as well as by each worker who is a union member.

Q11: If I file a complaint to remedy unfair labor practices, how long will the examination take?

A11: It depends on the nature of each case. Since January 1, 2008, the Commission has set a goal of completing its examination of each case within 18 months.

Q12: What measures can I take if I am dissatisfied with an order or decision issued by the Tokyo Metropolitan Government Labor Relations Commission?

A12: You can appeal the case with the Central Labor Relations Commission for re-examination, or bring the case to the Tokyo District Court to file a lawsuit to have the order rescinded.
